General provisions
These Terms of Use (the Terms) govern your use of the vardz.am website (the Site). By registering or using the Site, you accept these Terms and the Privacy Policy.
Vardz is a rental marketplace: owners post listings, and renters find them and send booking requests. If you do not agree with any part of the Terms, please do not use the Site.
Responsibility for content
The person who posts a listing is responsible for its content: the text, price, photos, description of condition and contact details. Vardz does not verify every listing, but may decline to publish or may remove a listing that breaks these Terms or the Listing Rules.
The Site's materials, including its design, texts, software code and brand, belong to vardz.am or their lawful owners. Copying, reproducing or distributing them without permission is not allowed.
By posting a listing, you confirm that you hold the rights to its content (including photos), and you grant vardz.am a non-exclusive, free licence to display, reproduce and distribute that content on the Site.
Listings may include YouTube videos. By watching them, you agree to the YouTube Terms of Service: YouTube Terms of Service(opens in a new tab)
Rights and duties of the parties
You agree to:
- provide truthful and current details, including a working email address and phone number
- not publish false, incomplete or misleading information about an item, its price or its condition
- not use automated programs (bots, scripts) to post listings in bulk, copy them or collect data
- not interfere with the Site or try to access other people's accounts
- use another user's contact details only for the booking or transaction concerned
- not impersonate another person or pose as another person or company
- keep your password secret: you are responsible for actions taken in your account
- hold one account: companies post listings through a company account
- challenge a moderator's decision through the Contact us page, rather than discussing it publicly or in listings
Vardz may ask you for an identity document, or for phone or identity verification. Failing to provide a requested document may be treated as providing false data.
False data
If you provide false data on the Site or deceive other users, Vardz may restrict or close your account and, as the law provides, pass your data to the affected person and to law enforcement.
Vardz's rights
Vardz may:
- set and change limits, such as a listing's duration, the size and number of photos, and the number of listings and requests
- change, add or remove Site features, both to improve the service and for security
- review listings, edit them or move them to the right category, and decline or remove them if they break these Terms or the Listing Rules
- restrict access, block or close an account for breaking the rules or on suspicion of fraud, without prior notice where necessary
Rentals between users
A rental agreement is made between the owner and the renter. They agree the price, deposit, pickup and return arrangements and the condition of the item between themselves. A booking request is sent through the Site, but it takes effect only when the owner confirms it.
From the moment a booking request is sent, each party can see the other's contact details so that they can arrange the handover. Use those details only for that booking.
At present the Site takes no part in payment of rent or deposit: the parties settle these directly. We recommend inspecting the item at pickup and return, keeping a record of what you agree, and not sending money before you have seen the item.
Units, payments and refunds
Paid features of the Site (for example, a listing beyond a category's free limit, a bump, a priority placement or a company package) are paid for in "units". 1 unit equals 1 AMD. You get units by the methods offered in the Wallet section. Prices are shown before you buy, and you buy at the price shown.
Units are not money. They are a way of getting services within the Site and cannot be exchanged for cash, except through the refund described below.
Refunds. Only purchased units that are still unspent can be refunded. A refund must be requested within 14 days of the top-up (with the "Ask for a refund" button in that section), and it is made at Vardz's decision after review.
- the part that is unspent at the time of the decision is refunded, up to the amount requested
- if part of the bonus given with the top-up has been spent, that part is deducted from the refund
- if a top-up brought a gift (for example, the first top-up gift), the gift amount is deducted from that top-up's refund, and the gift stays with you
- a bank fee for the transfer, if any, is deducted from the refund
- gifted units are not refunded, nor is an amount reserved for listings waiting in the queue
- services already received (bumps, priority placement) and company package terms are not refunded: a paid term keeps running until it ends
Vardz's error. If an amount was charged or a service delivered by our mistake, the correction is made in units, in your wallet.
Gifted units, including a top-up bonus, have a term and burn when it ends; the term is shown in the Wallet section. Purchased units do not expire.
Limitation of liability
Vardz is a platform that connects owners and renters. It is not a party to or organizer of a rental agreement, and it does not guarantee the accuracy of listings, the quality, legality or safety of items, the honesty of users or that agreements will be kept.
Disputes between users, whether about damage, delay, an item not returned or payment, are for the parties to resolve themselves. Vardz may help with information but is not a judge in the dispute.
The Site may contain links to third-party websites. Vardz is not responsible for their content or policies. The service is provided "as is", with no guarantee of uninterrupted operation. To the extent the law allows, Vardz is not liable for indirect losses.
Term
The Terms take effect when you start using the Site or register, and apply for as long as you use it. You can stop using the Site at any time and request that your account be closed in your profile settings. How an account is closed is described in the Privacy Policy.
Dispute resolution
The parties first try to resolve disputes arising from these Terms through negotiation. If they cannot agree, the dispute is heard in the courts of the Republic of Armenia under Armenian law. If a translation differs, the Armenian version of these Terms prevails.
Changes to the Terms
Vardz may change these Terms. The new version is published on this page with its update date. By continuing to use the Site after a change, you accept the new Terms.
